Spidle, et al., 13 Defendants. ) ) ) ) ) ) ) ) ) ) No. CV-07-198-SMM SETTLEMENT ORDER 14 15 Plaintiff is a state prisoner in this civil rights action brought under 42 U.S.C. ยง 1983. 16 On May 18, 2012, the parties held a settlement conference before Magistrate Judge Michael 17 J. Seng. (Doc. 290.) On May 21, 2012, this Court held a telephonic status conference 18 regarding those settlement discussions. (Doc. 291.) At the status conference, counsel for the 19 parties advised the Court that a settlement had been reached, and the parties are now in the 20 process of finalizing settlement documents. 21 Accordingly, the magistrate judge reference is withdrawn, and, 22 IT IS HEREBY ORDERED vacating all pending dates in this matter including the 23 trial date set for June 4, 2012, in Sacramento, California. 24 IT IS FURTHER ORDERED that counsel for the parties shall as soon as practicable 25 complete and finalize the necessary settlement documents once all necessary actions have 26 been undertaken by the parties pursuant to the settlement agreement. 27 28 IT IS FURTHER ORDERED that counsel for the parties shall as soon as practicable file a stipulated request for dismissal of this action. 1 IT IS FURTHER ORDERED acknowledging the professionalism and decorum in 2 which counsel conducted the litigation of this case. The Court commends both counsel for 3 the professional courtesy that they extended to one another during this litigation. The Court 4 expresses its deep satisfaction and appreciation for the enduring principle followed by 5 counsel that litigation courtesies do not disadvantage your litigation position but foster 6 professionalism amongst colleagues striving to best represent their clients.
