Civil No. 1:08cv1245 BTM (BLM) ORDER SETTING BRIEFING SCHEDULE RE DEFENDANTS' MOTION TO DISMISS AND SUBMITTING MATTER FOR DETERMINATION WITHOUT ORAL ARGUMENT Plaintiff, a state inmate currently incarcerated at Pleasant Valley State Prison located in Coalinga, California, filed this civil rights action pursuant to 42 U.S.C. § 1983 on August 22, 2008. He has been granted leave to proceed in forma pauperis ("IFP") pursuant to 28 U.S.C. § 1915(a). On July 8, 2009, Defendants filed a Motion to Dismiss pursuant to FED.R.CIV.P. 12(b)(6) [Doc. No. 16].
