Yates Doc. 61 1 2 3 4 5 6 7 8 9 EASTERN DISTRICT OF CALIFORNIA 10 11 DAVID ALLEN FALLS, 12 13 14 15 16 17 Petitioner is a state prisoner proceeding pro se with a petition for writ of habeas corpus 18 pursuant to 28 U.S.C. § 2254 on interlocutory appeal to the Ninth Circuit Court of Appeal. 19 On July 21, 2010, Petitioner filed a notice of appeal of the Court's orders denying motions 20 for extension of time and appointment of counsel. On July 29, 2010, the appeal was processed and 21 the record was transmitted to the Ninth Circuit Court of Appeals where the appeal is currently 22 pending. 23 On September 29, 2010, Petitioner filed the instant motion for evidentiary hearing. Petitioner 24 is advised that the notice of appeal effectively deprived this Court of jurisdiction to rule on 25 Petitioner's motion. Generally, the filing of a notice of appeal divests the district court of 26 jurisdiction with respect to all matters involved in the appeal. Griggs v.
