Ishii, and the 25 following scheduling order, which supercedes the discovery and scheduling order filed on September 26 14, 2010, now issues. 27 /// 28 1 1 I. Counsel of Record 2 Adam M. Leach, Esq., and Ralph M. Rios, Esq., on behalf of Plaintiff. 3 Kathleen J. Williams, Esq., and Lakeysia Rene Beene, Esq., on behalf of Defendant. 4 II. Consent to the Magistrate Judge 5 Pursuant to 28 U.S.C. § 636(c), the parties have not consented to conduct all further 6 proceedings in this case, including trial, before the Honorable Sheila K. Oberto, U.S. Magistrate 7 Judge. 8 III. 9 10 The parties are ordered to exchange the initial disclosures required by Fed. R. Civ. P. 26(a)(1) on or before 2/19/2013. 11 12 Discovery Plan and Cut-Off Date The parties are ordered to complete all discovery pertaining to non-experts on or before 6/21/2013, and all discovery pertaining to experts on or before 8/9/2013. 13 The parties are directed to disclose all expert witnesses, in writing, on or before 6/28/2013, 14 and to disclose all rebuttal experts on or before 7/19/2013. The written designation of retained and 15 non-retained experts shall be made pursuant to Fed. R. Civ. P. Rule 26(a)(2), (A), (B) and (C) 16 and shall include all information required thereunder. 17 compliance with this order may result in the Court excluding the testimony or other evidence offered 18 through such experts that are not disclosed pursuant to this order. Failure to designate experts in 19 The provisions of Fed. R. Civ. P. 26(b)(4) and (5) shall apply to all discovery relating to 20 experts and their opinions. Experts must be fully prepared to be examined on all subjects and 21 opinions included in the designation. Failure to comply will result in the imposition of sanctions, 22 which may include striking the expert designation and preclusion of expert testimony. 23 The provisions of Fed. R. Civ. P. 26(e) regarding a party's duty to timely supplement 24 disclosures and responses to discovery requests will be strictly enforced. 25 IV. Pre-Trial Motion Schedule 26 All non-dispositive pre-trial motions, including any discovery motions, shall be filed by no 27 later than 4:00 p.m. on 8/14/2013, and heard on or before 9/11/2013. Non-dispositive motions are 28 heard on Wednesdays at 9:30 a.m., before the Honorable Sheila K. Oberto, United States Magistrate 2 1 Judge in Courtroom 7. In scheduling such motions, the parties shall comply with Local Rule 230. 2 Counsel must comply with Local Rule 251 with respect to discovery disputes or the motion will 3 be denied without prejudice and dropped from calendar. In scheduling such motions, the 4 Magistrate Judge may grant applications for an order shortening time pursuant to Local Rule 144(e). 5 However, if counsel does not obtain an order shortening time, the notice of motion must comply with 6 Local Rule 251. 7 The parties are advised that unless prior leave of the Court is obtained, all moving and 8 opposition briefs or legal memorandum in civil cases before Judge Oberto shall not exceed thirty 9 (30) pages. Reply briefs by the moving party shall not exceed ten (10) pages. These page limitations 10 do not include exhibits. Briefs that exceed this page limitation, or that are sought to be filed without 11 leave, may not be considered by the Court. In addition, all pleadings shall be filed by no later than 12 4:00 p.m. on the due date. 13 Counsel may request to appear and argue non-dispositive motions by telephone, provided a 14 written request to so appear is made to the Magistrate Judge's Courtroom Clerk no later than five (5) 15 court days before the noticed hearing date and such request is granted. In the event that more than 16 one counsel requests to appear by telephone, then it shall be the obligation of the moving part(ies) 17 to arrange and originate a conference call to the court. Prior to filing a non-dispositive motion the 18 parties are ORDERED to meet, in person or by telephone, and confer to discuss the issues to be 19 raised in the motion. 20 All dispositive pre-trial motions shall be filed no later than 9/30/2013, and heard no later than 21 11/4/2013, in Courtroom 2, before the Honorable Anthony W. Ishii, Senior United States District 22 Court Judge. In scheduling such motions, counsel shall comply with Fed.R.Civ.P 56 and Local 23 Rules 230 and 260. 24 Motions for Summary Judgment or Summary Adjudication 25 Prior to filing a motion for summary judgment or motion for summary adjudication the 26 parties are ORDERED to meet, in person or by telephone, and confer to discuss the issues to be 27 raised in the motion. 28 /// 3 1 The purpose of the meeting shall be to: 1) avoid filing motions for summary judgment where 2 a question of fact exists, 2) determine whether the respondent agrees that the motion has merit in 3 whole or in part, 3) discuss whether issues can be resolved without the necessity of briefing, 4) 4 narrow the issues for review by the court, 5) explore the possibility of settlement before the parties 5 incur the expense of briefing a summary judgment motion, and 6) arrive at a joint statement of 6 undisputed facts. 7 The moving party shall initiate the meeting and provide a draft of the joint statement of 8 undisputed facts. In addition to complying with the requirements of Local Rule 260, the moving 9 party shall file a joint statement of undisputed facts. 10 In the notice of motion, the moving party shall certify that the parties have met and conferred 11 as ordered above or set forth a statement of good cause for the failure to meet and confer. 12 V. 13 14 Pre-Trial Conference Date December 18, 2013, at 8:30 a.m. in Courtroom 2 before the Honorable Anthony W. Ishii, Senior United States District Judge. 15 The parties are ordered to file a Joint Pretrial Statement pursuant to Local Rule 281(a)(2). 16 The parties are further directed to submit a digital copy of their pretrial statement in Word Perfect 17 X41 format, directly to Judge Ishii’s chambers by email at AWIorders@caed.uscourts.gov. 18 The parties' attention is directed to Rules 281 and 282 of the Local Rules of Practice for the 19 Eastern District of California, as to the obligations of counsel in preparing for the pre-trial 20 conference. The Court will insist upon strict compliance with those rules. In addition to the matters 21 set forth in the Local Rules, the Joint Pretrial Statement shall include a joint statement of the case 22 to be used by the Court to explain the nature of the case to the jury during voir dire. 23 VI. 24 25 26 Trial Date January 28, 2014, at 8:30 a.m. in Courtroom 2 before the Honorable Anthony W. Ishii, Senior United States District Court Judge. a. This is a jury trial. 27 1 28 If W ordPerfect X4 is not available to the parties then the latest version of W ordPerfect available to the parties or any other word processing program in general use for IBM compatible personal computers is acceptable. 4 1 b. Parties' estimate of trial time: 3-5 days. 2 c. The parties' attention is directed to Local Rules of Practice for the Eastern District of 3 4 California, Rule 285 for preparation of trial briefs. VII. Settlement Conference 5 A settlement conference is scheduled for 8/13/2013, at 10:00 a.m. in Courtroom 7 before the 6 Honorable Sheila K. Oberto, U.S. Magistrate Judge. Unless otherwise permitted in advance by the 7 Court, the attorneys who will try the case shall appear at the settlement conference with the 8 parties and the person or persons having full authority to negotiate and settle the case on any 9 terms2 at the conference. 10 CONFIDENTIAL SETTLEMENT CONFERENCE STATEMENT 11 At least five (5) court days prior to the settlement conference the parties shall submit, directly 12 to Judge Oberto's chambers by e-mail to SKOorders@caed.uscourts.gov, a Confidential Settlement 13 Conference Statement. The statement should not be filed with the Clerk of the Court or served on 14 any other party; however, the parties are required to file their Notice of Submission of 15 Confidential Settlement Conference Statement (See Local Rule 270(d)). Each statement shall be 16 clearly marked "confidential" with the date and time of the settlement conference indicated 17 prominently thereon. The parties are urged to request the return of their statements if a settlement 18 is not achieved, and if such a request is not made, the Court will dispose of the statement. 19 The Confidential Settlement Conference Statement shall include the following: 20 A. A brief statement of the facts of the case. 21 B. A brief statement of the claims and defenses, i.e., statutory or other grounds upon which 22 the claims are founded, a forthright evaluation of the parties' likelihood of prevailing on the claims 23 and defenses, and a description of the major issues in dispute. 24 C. A summary of the proceedings to date. 25 2 26 27 28 Insurance carriers, business organizations, and governmental bodies or agencies whose settlement agreements are subject to approval by legislative bodies, executive committees, boards of directors or the like shall be represented by a person or persons who occupy high executive positions in the party organization and who will be directly involved in the process of approval of any settlement offers or agreements. To the extent possible, the representative shall have the authority, if he or she deems it appropriate, to settle the action on terms consistent with the opposing party's most recent demand. 5 1 D. An estimate of the cost and time to be expended for further discovery, pretrial and trial. 2 E. The relief sought. 3 F. The party's position on settlement, including present demands and offers and a history of 4 past settlement discussions, offers and demands. 5 Should the parties desire a settlement conference, they will jointly request one of the court, 6 and one will be arranged. In making such request, the parties are directed to notify the court as to 7 whether or not they desire the undersigned to conduct the settlement conference or to arrange for one 8 before another judicial officer. 9 VIII. Request for Bifurcation, Appointment of Special Master, or Other Techniques to 10 Shorten Trial 11 Not applicable at this time. 12 IX. 13 14 Related Matters Pending There are no pending related matters. X. Compliance with Federal Procedure 15 All parties are expected to familiarize themselves with the Federal Rules of Civil Procedure 16 and the Local Rules of Practice of the Eastern District of California, and to keep abreast of any 17 amendments thereto. The Court must insist upon compliance with these Rules if it is to efficiently 18 handle its increasing case load and sanctions will be imposed for failure to follow the Rules as 19 provided in both the Federal Rules of Civil Procedure and the Local Rules of Practice for the Eastern 20 District of California. 21 XI. Effect of this Order 22 The foregoing order represents the best estimate of the court and counsel as to the agenda 23 most suitable to dispose of this case. The trial date reserved is specifically reserved for this case. 24 If the parties determine at any time that the schedule outlined in this order cannot be met, counsel 25 are ordered to notify the court immediately of that fact so that adjustments may be made, either by 26 stipulation or by subsequent status conference. 27 The dates set in this order are considered to be firm and will not be modified absent a 28 showing of good cause even if the request to modify is made by stipulation.
