On January 14, 2009, the Court issued a Scheduling Order. The Scheduling 19 Order states that Defendant's responsive brief is due within thirty days of service of Plaintiff's 20 opening brief. 21 On September 25, 2009, after receiving an extension of time, Plaintiff filed her opening brief. 22 Pursuant to the Scheduling Order, Defendant's responsive brief was due on or before October 25, 23 2009. Defendant has failed to file a brief. 24 Therefore, Defendant is ORDERED TO SHOW CAUSE, if any he has, why sanctions should 25 not be imposed for failure to comply with the Court's orders.
