However, on March 26, 2009, the Court issued an order that construed document number 13 as an amended petition/complaint. See Court's Docket Doc. No. 20. Hearing on these matters is set for April 13, 2009.1 Pursuant to Local Rule 78-230(c), the court has reviewed the moving papers and has determined that these matters are suitable for decision without oral argument. Local Rule 78-230(h). Therefore, IT IS HEREBY ORDERED that the previously set hearing date of April 13, 2009, is VACATED, and the parties shall not appear at that time.
