ASTRUE, COMMISSIONER OF SOCIAL 13 SECURITY, 14 15 16 Plaintiff is proceeding pro se with an action seeking 17 judicial review of a final decision of the Commissioner of Social 18 Security (Commissioner) denying Plaintiff's application for 19 benefits. 20 I. Application to Proceed in Forma Pauperis 21 Pending before the Court are Plaintiff's motions to proceed 22 in forma pauperis, filed on March 2, 2009, and April 13, 2009. 23 Plaintiff has submitted a declaration that makes the showing 24 required by § 1915(a). Accordingly, the request to proceed in 25 forma pauperis IS GRANTED. 28 U.S.C. § 1915(a). 26 II. Informational Order to Plaintiff 27 Plaintiff IS INFORMED that in a case in which the Plaintiff 28 1 Defendant. ) ) ) ) ) ) ) ) ) ) ) ) 1:09-cv-00380-OWW-SMS ORDER GRANTING PLAINTIFF'S APPLICATION TO PROCEED IN FORMA PAUPERIS (DOCS. 2, 4) INFORMATIONAL ORDER TO PLAINTIFF REGARDING THE COURT'S SCREENING PLAINTIFF'S COMPLAINT BEFORE SERVICE IS ORDERED 1 is proceeding in forma pauperis, the Court is required to screen 2 the complaint and shall dismiss the case at any time if the Court 3 determines that the allegation of poverty is untrue, or the 4 action or appeal is frivolous or malicious, fails to state a 5 claim on which relief may be granted, or seeks monetary relief 6 against a defendant who is immune from such relief. 28 U.S.C. § 7 1915(e)(2). The Court will direct the United States Marshal to 8 serve Plaintiff's complaint only after the Court has screened the 9 complaint and determined that it contains cognizable claims for 10 relief against the named defendants.
