pursuant to the Delt a Smelt Biological Opinion, b a s e d on the non- p r e s e n c e of Delta Smelt in th e vicinity of the pumps, f i s h collecti o n facilities, or other areas of concern, there is no present irreparable injury o r imminent threat of i n j u r y as there is no indicati o n that any Reas o n a b l e and P r u d e n t Alternative will affect a reductio n in pumping of water for storage and lat e r delivery to State an d Federal Contractors. For thes e reasons, t h e r e is no showing of imminen t injury o r irreparabl e harm, and an absence of any present need for a temporary restraining order. All Plaintiff s
