This action is proceeding against Defendants Munoz, Dicks, Rocha, and Blasdell for violation of the Eighth Amendment and First Amendment. On July 26, 2010, Plaintiff filed a document entitled "Unenumerated 12(b) motion" and in it, Plaintiff presents arguments as to why his case should not be dismissed for failure to exhaust his administrative remedies. On August 9, 2010, Defendants filed a motion to dismiss. Plaintiff has failed to file an opposition or a statement of non-opposition to the motion. Local Rule 230(l). Accordingly, it is HEREBY ORDERED that: 1. 2.
