Plaintiff Francisco Gil (“Plaintiff”) was formerly a California state prisoner. Plaintiff is
16
proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983.
17
This action is proceeding against Defendant Amadi for deliberate indifference in violation of the
18
Eighth Amendment and negligence.
19
Pending before the Court is Plaintiff’s motion to postpone Defendant’s motion for
20
summary judgment, filed July 7, 2011. Plaintiff requests an extension of time to oppose
21
Defendant’s motion. Plaintiff’s motion is unnecessary. No motion for summary judgment has
22
been filed. Defendant Amadi has not filed an answer or other responsive pleading. Accordingly,
23
it is HEREBY ORDERED that Plaintiff’s motion, filed July 7, 2011, is DISREGARDED.
