1 2 3 4 5 6 7 8 9 LIONEL FALCON, 10 11 12 13 14 15 Petitioner is a state prisoner proceeding pro se with a petition for writ of habeas corpus 16 pursuant to 28 U.S.C. § 2254. 17 On January 27, 2010, Petitioner filed a motion to expedite proceedings in the pending 18 petition for writ of habeas corpus. As Petitioner correctly states, the instant action is pending before 19 this Court. However, the Court does not have an expedited calendar. Petitioner is advised that the 20 Court acts to resolve all pending cases in the most efficient manner possible. The Court is aware of 21 Petitioner's pending petition. Nevertheless, the Court's docket of pending cases is substantial, and 22 the Court must act first on those matters that have been pending the longest. 23 Accordingly, Petitioner's motion to expedite the pending petition for writ of habeas corpus is 24 DENIED. 25 26 IT IS SO ORDERED. 27 Dated: 28 U .
