The Court has screened 17 Plaintiff's complaint pursuant to 28 U.S.C. § 1915A, and finds that it states claims against 18 Defendants Williams and Gonzales for use of excessive force and for subjecting Plaintiff to 19 unconstitutional conditions of confinement following the incident of force, in violation of the Eighth 20 21 Corp. v. "Declaratory relief should be denied when it will neither serve a useful purpose in clarifying and settling the legal relations in issue nor terminate the proceedings and afford relief from the uncertainty and controversy faced by the parties." U.S. v. State of Wash., 759 F.2d 1353, 1357 (9th Cir. 1985) (citations omitted). The governmental conduct at issue in this action occurred in 2005, and Plaintiff's remedy is limited to money damages should he prevail on his claim that his constitutional rights were violated. Accordingly, it is HEREBY ORDERED that: 1. 2. Plaintiff 's claim for declaratory relief is dismissed for failure to state a claim. Service shall be initiated on the following defendants: C/O R. J. WILLIAMS C/O M. GONZALES 3. The Clerk of the Court shall send Plaintiff two (2) USM-285 forms, two (2) summonses, a Notice of Submission of Documents form, an instruction sheet and a copy of the complaint filed May 4, 2009. 4. Within thirty (30) days from the date of this order, Plaintiff shall complete the attached Notice of Submission of Documents and submit the completed Notice to the Court with the following documents: a. b. c. 5. Completed summons; One completed USM-285 form for each defendant listed above; and Three (3) copies of the endorsed complaint filed May 4, 2009. Plaintiff need not attempt service on the defendants and need not request waiver of service.
