Upon receipt of the expert report from Defendants on the issue of the standard of care, Plaintiff intends to retain and designate a rebuttal expert. Because the parties have conferred informally regarding the anticipated scope of expert testimony on the standard of care, Plaintiff has already started the process of retaining a rebuttal witness. However, Plaintiff's witness will be unavailable until after the July 4 holiday to begin his evaluation. Accordingly, the parties jointly request that the case schedule be modified as follows: Old Dates Supplemental Expert disclosure: Expert discovery: 6/25/10 7/16/10 New Dates 7/23/10 8/20/10 The Non-Dispositive motion filing deadline of July 16, 2010, Settlement Conference of August 19, 2010, the Pre-trial Conference of August 30, 2010, and the Trial date of October 5, 2010, will remain the same.
