Defendants have answered the complaint and the action is currently in the discovery phase. 18 19 On August 19, 2013, Plaintiff filed a Motion to Dismiss this action. Pursuant to Federal Rule of Civil Procedure 41(a)(2), the dismissal would be without prejudice. 20 21 Accordingly, IT IS HEREBY ORDERED that Defendants file an opposition or statement of non-opposition to Plaintiff’s Motion to Dismiss within ten days of the date of service of this order. 22 23 24 25 IT IS SO ORDERED.
