The Findings and Recommendation was served on all parties and contained notice 21 that any objections were to be filed within thirty (30) days. Over thirty (30) days have passed and 22 Plaintiff has not filed objections. 23 In accordance with the provisions of 28 U.S.C. § 636 (b)(1)(c), this Court has conducted a 24 de novo review of the case. Accordingly, IT IS HEREBY ORDERED that: 1. The Findings and Recommendations dated December 3, 2009, is ADOPTED IN FULL; and 2. Defendants Dyer, Wilson, Durham and Madrid are DISMISSED WITHOUT LEAVE TO AMEND.
