ASTRUE, ) Commissioner of Social Security, ) 15 Defendant. ) 16 ______________________________) 17 18 19 IT IS HEREBY STIPULATED by and between the parties through their undersigned counsel, subject to the approval of the Court, that Plaintiff be awarded attorney fees under the 20 Equal Access to Justice Act (EAJA), 28 U.S.C. § 2412(d), in the amount of FOUR THOUSAND 21 SIX HUNDRED FIFTY DOLLARS AND 00 CENTS ($4,650.00). This amount represents 22 compensation for all legal services rendered on behalf of Plaintiff by counsel in connection with 23 this civil action, in accordance with 28 U.S.C. § 2412(d). 24 25 After the Court issues an order for EAJA fees to Plaintiff, the government will consider 26 the matter of Plaintiff's assignment of EAJA fees to Plaintiff's attorney. Pursuant to Astrue v. 27 Ratliff, 130 S.Ct. 2521 (2010), the ability to honor the assignment will depend on whether the fees 28 Stip. & Prop. Fees shall be made payable to Plaintiff, but if the Department of the Treasury determines Program.
