1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 Plaintiff Miguel Herrera filed the instant action in Kern County Superior Court on June 19, 17 2009, against Defendants CitiMortgage, Inc. and First NLC Financial, LLC. Defendant CitiMortgage 18 Inc., removed the action to this Court on October 13, 2009. 19 On October 14, 2009, the Court issued civil new case documents. The civil new case 20 documents included an Order Setting Mandatory Scheduling Conference for December 16, 2009. On 21 November 23, 2009, pursuant to Plaintiff's notice of voluntary dismissal, Defendant CitiMortgage, 22 Inc., was dismissed from this action. IT IS HEREBY ORDERED by the Court that Plaintiff's counsel appear in person on December 31, 2009, at 9:00 a.m. in Courtroom 9 of the above-entitled Court, located at 2500 Tulare Street, Fresno, California, to show cause, if any there be, why this action should not be dismissed for failure to appear and failure to prepare a joint scheduling report.
