Plaintiff has consented to magistrate judge jurisdiction pursuant to 28 U.S.C. § 18 636(c)(1). 19 By order filed October 26, 2010, the operative complaint was dismissed for failure to 20 state a claim. Plaintiff was granted leave to file an amended complaint, and directed to do so 21 within thirty days. Plaintiff has not filed an amended complaint. 22 In the October 26, 2010, order the Court informed Plaintiff of the deficiencies in his 23 complaint, and dismissed the complaint on the ground that Plaintiff had failed to state a claim 24 upon which relief could be granted.
