On November 29, 2010, Plaintiff 17 filed a noticing informing the Court that he wishes to voluntarily dismiss this action. (Doc. #17.) 18 Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A), a plaintiff may dismiss an action without 19 a court order by filing a notice of dismissal before an opposing party serves either an answer or a 20 motion for summary judgment. 21 Accordingly, it is HEREBY ORDERED that this action is dismissed, without prejudice, 22 pursuant to Plaintiff's notice of voluntary dismissal. 23 24 IT IS SO ORDERED. 25 26 27 28 1
