For the reasons stated in the memorandum decision dated February 11, 2011 (Doc. 161), the Court finds that applicants Mitsubishi Heavy Industries, Ltd. and Mitsubishi Power Systems Americas, Inc. have met the requirements for intervention as of right pursuant to Fed. R. Civ. P. 24(a)(2). Accordingly, it is hereby ORDERED that: 1. The motion of Mitsubishi Heavy Industries, Ltd. and Mitsubishi Power Systems Americas, Inc. to intervene as party defendants pursuant to Fed. R. Civ. P. 24(a)(2) is GRANTED; and 2. Mitsubishi Heavy Industries, Ltd. and Mitsubishi Power Systems Americas, Inc. shall file an answer if and when an answer becomes due for defendant Thomas Wilkins.

IT IS SO ORDERED.
