Johnson, a state prisoner proceeding pro se, filed this civil 19 rights action pursuant to 42 U.S.C. § 1983 on May 10, 2010, and a scheduling order 20 was issued on November 1, 2013. The action is currently in the discovery phase, and 21 on March 26, 2014, Defendant filed a motion seeking leave to depose Plaintiff by 22 videoconference. Fed. R. Civ.
