IT IS STIPULATED BETWEEN THE PARTIES hereto that the Scheduling Order be amended

to change the Non-Expert Discovery cut-off date from November 7, 2011, to March 9, 2012, the same

18

date as the cut-off for Expert Discovery. This change is requested because of on-going settlement

19

discussions between the parties and the desire to minimize costs while the negotiations are going on.

20

All other dates in the Scheduling Order shall remain the same except for the Trial date which

21

was changes from July 16, 2012 to July 24, 2012, by the Court in its Order of October 27, 2011.

Non-expert discovery SHALL be completed no later than March 9, 2012;

No other deadlines in the scheduling order are extended by this amendment.

No further amendments to the scheduling order will be permitted absent a showing of

exceptional good cause.
