Defendants have notice for 20 hearing and decision a motion to dismiss pursuant to Rule 12(b)(6) of the Federal Rules of 21 Civil Procedure. The matter was scheduled for oral argument to be held September 27, 2010. 22 The Court has reviewed Plaintiffs' motion. Plaintiff's opposition, which was due not later 23 than September 20, 2010, was not filed as of that date and consequently the motion may not 24 be opposed at oral argument. Local Rule 78-230(b). The court has determined that the 25 motion is suitable for decision without oral argument. Local Rule 78-230(h). 26 Therefore, IT IS HEREBY ORDERED that the previously set hearing date of 27 September 27, 2010, is VACATED, and no party shall appear at that time.
