Currently pending before the Court is Defendant Suntrust Mortgage, Inc’s motion to

dismiss Plaintiffs’ Second Amended Complaint. This motion is set for hearing on August 22,

20

2011, at 1:30 p.m. in Courtroom 2. The Court has reviewed the papers and has determined that

21

this matter is suitable for decision without oral argument. See Local Rule 230(g). Therefore, IT

22

IS HEREBY ORDERED that the previously set hearing date of August 22, 2011, is VACATED,

23

and the parties shall not appear at that time. As of August 22, 2011, the Court will take the

24

matter under submission, and will thereafter issue its decision.
