Currently pending before the Court is Defendant Suntrust Mortgage, Inc’s motion to

dismiss Plaintiffs’ Third Amended Complaint. This motion is set for hearing on November 21,

20

2011, at 1:30 p.m. in Courtroom 2. The Court has reviewed the papers and has determined that

21

this matter is suitable for decision without oral argument. See Local Rule 230(g). Therefore, IT

22

IS HEREBY ORDERED that the previously set hearing date of November 21, 2011, is

23

VACATED, and the parties shall not appear at that time. As of November 21, 2011, the Court

24

will take the matter under submission, and will thereafter issue its decision.
