EXTENSION OF TIME

The parties hereby stipulate through counsel, with the Court’s approval as indicated by issuance

of the attached Order, that Defendant shall have a first extension of time of 30 days to respond to
22
Plaintiff’s opening brief. The extension is needed due to defense counsel’s recent medical leave, and to
23
allow for proper review of the case in light of the arguments for remand presented in Plaintiff’s brief.

Defendant’s current deadline is October 11, 2011, and the new deadline will be November 10, 2011.
