FRESNO COUNTY SUPERIOR COURT, et al., Date: July 29, 2011 Time: 9:30 a.m. Courtroom 7 12 Defendants. 13 / 14 15 On January 24, 2011, this Court struck Plaintiff’s complaint for failure to comply with the 16 requirements of F.R.Civ.P. 11, specifically the failure of Plaintiff’s counsel to sign the complaint. 17 Noting that the complaint totaled 569 pages, the Court granted Plaintiff the right to amend in 18 conformity with F.R.Civ.P. 8 and 11. On March 10, 2011, Plaintiff again filed the 569-page 19 complaint, purportedly signed by counsel. Thereafter, this Court ordered counsel for Plaintiff 20 appear at a hearing set for 9:00 a.m., March 30, 2011, before the Honorable Sandra M. Snyder, 21 United States Magistrate Judge, prepared to show cause why this case should not be dismissed 22 with prejudice, and sanctions imposed, for failure to comply with the Federal Rules of Civil 23 Procedure. Plaintiff responded by adding the Clerk of Court as a Defendant in this case and 24 moving this Court for a continuance of the hearing pending service of the complaint. 25 After this Court denied Plaintiff’s motion for a continuance, Plaintiff filed an 26 interlocutory appeal with the United States Court of Appeal for the Ninth Circuit. On May 27, 27 2011, the Court of Appeal dismissed Plaintiff’s interlocutory appeal for failure to respond to a 28 court order. 1 This Court hereby ORDERS that counsel for Plaintiff appear at a hearing set for 9:30 2 a.m., July 29, 2011, before the Honorable Sandra M. Snyder, United States Magistrate Judge, 3 prepared to show cause why this case should not be dismissed with prejudice, and sanctions 4 imposed, for failure to comply with the Federal Rules of Civil Procedure.
