(“Defendant”) 14 has filed a motion for award of attorney’s fees from plaintiffs Donald Ward and Carrie Lynn 15 Carlile-Ward. Defendant’s motion for award of attorney’s fees was set for oral argument to 16 be held on December 12, 2011. Defendants’s opposition to Plaintiff’s motion, which was 17 due not later than December 3, 2011, has not been filed as of the date of this order, 18 consequently the motion may not be opposed at oral argument. Local Rule 78-230(b). The 19 court has determined that this motion is suitable for decision without oral argument. Local 20 Rule 78-230(h). 21 Therefore, IT IS HEREBY ORDERED that the previously set hearing date of 22 December 12, 2011, is VACATED, and no party shall appear at that time. As of December 23 12, 2011, the Court will take the matter under submission, and will thereafter issue its 24 decision, taking into account the Magistrate Judge’s order. 25 26 27 28 IT IS SO ORDERED.
