In this action for damages, defendant Tommy Jones, et al. (“Defendant”) has moved

17

for summary judgment on the Second Amended Complaint of plaintiff Eugene Forte

18

(“Plaintiff”). The matter was scheduled for oral argument to be held February 11, 2013. The

19

Court has reviewed Defendant’s motion, Plaintiff’s opposition, and Defendant’s reply, and

20

the applicable law, and has determined that the motion is suitable for decision without oral

21

argument. Local Rule 78-230(h).

Therefore, IT IS HEREBY ORDERED that the previously set hearing date of

23

February 11, 2013, is VACATED, and no party shall appear at that time. As of February 11,

24

2013, the Court will take the matter under submission, and will thereafter issue its decision.
