IT IS HEREBY STIPULATED, by and between the undersigned attorneys, subject to the approval

of the Court, that Defendant shall have a one-week extension, or until November 16, 2012, in which to
21
file his Opposition to Plaintiff’s Application for Attorneys Fees under the Equal Access to Justice Act.

On October 11, 2012, the Court issued a minute order, requiring Defendant to file his opposition
23
by November 9, 2012. Because of a calendaring error by the undersigned counsel of record, Defendant
24
requires additional time to prepare his opposition.

This is Defendant’s first request for an extension of time in this matter and is not intended to cause

intentional delay. The undersigned counsel for the Defendant expresses her apologies for any

inconvenience to the Court.

The Court adopts the stipulation of the parties filed on this date. Accordingly, the Commissioner
