Even though the case was already dismissed pursuant 21 to the August 6, 2011 order, the court finds that the August 30, 2011 motion should be 22 granted to clarify any inconsistency on whether this action is dismissed. 23 Accordingly, the court ORDERS that Plaintiff’s motion to dismiss is GRANTED 24 under Rule 41 of the Federal Rules of Civil Procedure. 25 IT IS SO ORDERED. 26 27 28 Dated: 0m8i78 March 23, 2012 CHIEF UNITED STATES DISTRICT JUDGE
