Plaintiff William Gonzalez (“Plaintiff”) is a prisoner in the custody of the California
16
Department of Corrections and Rehabilitation (“CDCR”). Plaintiff is proceeding pro se in this civil
17
action pursuant to 42 U.S.C. § 1983. On December 13, 2012, Plaintiff filed a motion requesting
18
dismissal of this action without prejudice. ECF No. 13.
19
The plaintiff may dismiss an action without a court order when a stipulation of dismissal is
20
signed by all parties who have appeared. Fed. R. Civ. P. 41(a)(1)(A)(ii). Plaintiff is the only party
21
to appear in this action.
Accordingly, it is HEREBY ORDERED that the Clerk of the Court is directed to close this
22
23
action pursuant to Plaintiff’s notice of dismissal.
