Plaintiff Robert Roy Martinez is proceeding pro se in this civil rights action. On
22
February 16, 2012, the Magistrate Judge granted Plaintiff’s application to proceed in forma
23
pauperis pursuant to 28 U.S.C. § 1915(a). The court advised Plaintiff that the court is required
24
to screen complaints of pro se litigants proceeding in forma pauperis pursuant to 28 U.S.C. §
25
1915A(a).

The reason for screening is that the court must dismiss a complaint or portion thereof if
27
the litigant has raised claims that are legally “frivolous or malicious,” that fail to state a claim
28
upon which relief may be granted, or that seek monetary relief from a defendant(s) who is

immune from such relief. 28 U.S.C. § 1915A(b)(1)&(2).
