Docs. 109 and 111. The motions are opposed. Docs. 112 and 113. The court has 21 reviewed the papers filed and has determined that the motion is suitable for decision without 22 further oral argument. See Local Rule 230(g). 23 Therefore, IT IS HEREBY ORDERED that the previously set hearing date of February 24 25, 2013, is VACATED, and no party shall appear at that time. As of that date, the court will 25 take the matter under submission and will thereafter issue its decision. 26 Previously, the Dorrohs and Cedar made motions for Cedar to substitute/join in as a 27 plaintiff in this suit. Docs. 93 and 94. Their motions were denied. Doc. 108. They have now 28 appealed that order to the Ninth Circuit. Doc. 114. This appeal affects how the case will proceed 1 1 and whether any trial without Cedar would be useful.
