Now pending before the Court is Plaintiff’s motion for appointment of counsel filed on September 24, 2013. On September 10, 2013, the Court dismissed Plaintiff’s complaint, with leave to amend, for 22 failure to state a claim. Plaintiff was granted thirty days from the date of service of that order to file an 23 amended complaint. 24 25 On September 24, Plaintiff filed a notice of appeal of the Court’s September 10, 2013, screening order. 26 Plaintiff’s motion for appointment of counsel is directed to the United States Court of Appeal 27 for the Ninth Circuit.
