Eikenberry, 849 F.2d 409 (9th Cir. 1988) and Rand v. 19 Rowland, 154 F.3d 952 (9th Cir. 1998), of the following requirements for opposing the motion for 20 summary judgment made by defendants pursuant to Rule 56 of the Federal Rules of Civil Procedure: 21 22 23 24 1. Such a motion is a request for an order for judgment on some or all of plaintiff’s claims in favor of defendants without trial. See Rule 56(b). 2. Defendants’ motion set forth the facts which defendants contend are not reasonably subject to dispute and that entitle them to judgment as a matter of law. See Rule 56(c). 25 3. Plaintiff has the right to oppose the motion for summary judgment. To oppose the motion, 26 plaintiff must show proof of his or her claims. Plaintiff may agree with the facts set forth in 27 defendants’ motion but argue that defendants are not entitled to judgment as a matter of law. 28 4. Plaintiff may show defendants’ facts are disputed in one or more of the following ways: 1 1 a. Plaintiff may rely upon statements made under the penalty of perjury in the 2 complaint if the complaint shows that plaintiff has personal knowledge of the matters 3 stated and if plaintiff calls to the court's attention those parts of the complaint upon 4 which plaintiff relies; 5 b. Plaintiff may also serve and file affidavits or declarations setting forth the facts 6 which plaintiff believes prove plaintiff's claims (the persons who sign the affidavit or 7 declaration must have personal knowledge of the facts stated); 8 9 c. Plaintiff may also rely upon written records but plaintiff must prove that the records are what plaintiff claims they are; 10 d. Plaintiff may also rely upon all or any part of the transcript of one or more 11 depositions, answers to interrogatories, or admissions obtained in this proceeding. 12 Should plaintiff fail to contradict defendants’ motion with affidavits, declarations, or 13 other evidence, defendants’ evidence will be taken as truth, and final judgment may 14 be entered without a full trial. See Rule 56(e). 15 5. If there is some good reason why such facts are not available to plaintiff when required to 16 oppose such a motion, the court will consider a request to postpone considering 17 defendant(s)’ motion. See Rule 56(f). 18 6. If plaintiff does not serve and file a request to postpone consideration of defendants’ motion 19 or written opposition to the motion, the court may consider plaintiff’s failure to act as a 20 waiver of opposition to defendants’ motion. Plaintiff’s waiver of opposition to defendants’ 21 motion may result in the entry of summary judgment in favor of defendants and against 22 plaintiff. 23 7. A motion supported by affidavits or declarations that are unsigned will be stricken. 24 8. The failure of any party to comply with this order, the Federal Rules of Civil Procedure, or 25 the Local Rules of Court, may result in the imposition of sanctions including, but not limited 26 to, dismissal of the action or entry of default. 27 9. Plaintiff is advised that any declarations submitted by him must be dated and signed under 28 penalty of perjury. His own declaration must set forth every fact within his personal 2 1 knowledge that he relies upon to oppose the motion. He cannot merely say that facts set 2 forth in other documents are true; the facts must be set forth in the declaration itself. Also, 3 all declarations must set forth how the declaring witness knows the information to which he 4 attests whether by the witness seeing something happen, hearing it, or feeling it, for 5 example.
