The parties hereto, through their respective counsel, hereby stipulate that in order

to provide sufficient time to resolve this matter through settlement, defendants shall have

to and including October 23, 2012, in which to file a responsive pleading in the

above-referenced matter.

This is the second extension agreed to by the parties. The first extension granted

defendants an extension of time to respond from September 4, 2012, until October 2,

25

2012.
