On February 19, 2013, defendants Terry Freeman, David Watts, and Rodney Walthers filed a

motion to dismiss the complaint filed by Karen Harris (“Plaintiff”). (Doc. 19). On March 11, 2013,

Plaintiff filed her First Amended Complaint as permitted under Rule 15 of the Federal Rules of Civil
21
Procedure. (Doc. 29). Accordingly, IT IS HEREBY ORDERED: Defendants’ motion to dismiss
22
(Doc. 19) is DENIED AS MOOT.
