56 NOTICE: During the hearing held on May 6, 2013, the parties were
requested to designate one plaintiffs representative and one defendants'
representative to jointly contact the Court for the purpose of selecting a
date for an informal status conference. [MDL Record No. 2625]
Following the hearing, Richard Schulte was designated as the plaintiffs'
representative with Mary Larrimore being designated as the defendants'
representative. The call was scheduled for May 16, 2013, beginning at
12:15 p.m. Although Mr. Schulte and the undersigned joined the call at
the appointed time, Ms. Larrimore did not. Later, the parties submitted
proposed dates for the informal status conference; however, those dates
conflict with other matters. Therefore, as a result of Ms. Larrimore's
failure to participate or have other counsel participate in the May 16,
2013, telephone conference, the Court will be unable to schedule the
matter prior to June 30, 2013. The purpose of this Notice is to provide
the parties with the reason the informal status conference will not be

deadlines for plas' fact sheets, product identification discovery responses,
and discovery concerning cumulative/latent injuries have been agreed
upon for the cases in which they were overdue, with the exception of
Shaw, et al. v. Eli Lilly & Co., et al. (Civil Action No. 2:12-243-DCR)
and Zgoda v. Eli Lilly & Co., et al. (Civil Action No. 2:13-66-DCR). In
the event that the parties are unable to agree to a new deadline for those
plas to provide the required discovery, the defs may file a motion
requesting the entry of an order directing the plas to show cause why
their claims should not be dismissed for failure to prosecute; 2)
Xanodyne has reached an agreement w/plas regarding search terms for
their Electronically Stored Information ("ESI"). If Eli Lilly and the plas
cannot resolve their dispute over ESI search terms, they shall file
simultaneous briefs on this issue on or before 9/3/2013. Responses will
be due 10 days thereafter, at which time the briefs will stand submitted;
3)Parties are directed to confer and submit proposed dates for the next
Status Conference. In that submission, parties should indicate whether
they wish to set aside time for an informal meeting concerning
settlement; 4)Prior to the next Status Conference, the current leadership
for the plas shall communicate w/counsel for plas who have cases
remaining in this MDL proceeding and prepare a list of suggestions for

status conference, counsel for the parties shall prepare and tender to the

and Plaintiffs' Steering Committee (including, but not limited to, Case
Management and Scheduling Order No. 1, dated October 4, 2011 [MDL

200]). The proposed order shall address establishment of a Plaintiffs'
Appellate Committee as well as other modifications that the parties wish
