Plaintiff Brady K. Armstrong is appearing pro se and in forma pauperis in this civil rights

action pursuant to 42 U.S.C. § 1983.
On December 12, 2014, the Court issued a Findings and Recommendation to dismiss the action
17
18
for Plaintiff’s failure to comply with a court order. Plaintiff submits that he has been in and out of
19
emergency care for medical treatment.
20
Based on Plaintiff’s representations in his motion and in the interest of justice, the Court
21
hereby VACATES the Findings and Recommendations to dismiss the action, and Plaintiff’s motion to
22
extend the time to file objections is DENIED as MOOT.
