This matter is before the Court on plaintiff United States’ Ex Parte Motion for

Default Judgment filed April 7, 2014. The Magistrate Judge has recommended that the

United States’ motion for default judgment be granted. The time for objecting to the

21

Findings and Recommendations of the Magistrate has passed and no timely objections have

22

been filed. An Order Adopting the Magistrate Judge’s Findings and Recommendations was

23

filed on July 7, 2014. Based on the Magistrate Judge’s Findings and Recommendations on

24

Plaintiff’s Ex Parte Application for Default Judgment, the Order Adopting the Magistrate

25

Judge’s Findings and Recommendations, and the files and records of the Court, it is

26

ORDERED, ADJUDGED, AND DECREED:

1. The Court adopts the Magistrate Judge’s June 9, 2014 Findings and

28

Recommendations in full.

2. Saleh Muqbel Saeed, Muneer Muqbel Saeed, Sami Ali Muthana, and the Shoe
Farm are held in default.

3. A judgment by default is hereby entered against any right, title, or interest in the

4

defendant approximately 335 Counterfeit NFL Jerseys (hereafter “defendant jerseys”), and

5

all potential claimants who have not filed claims in this action.

4. A final judgment is hereby entered forfeiting all right, title, and interest in the

7

defendant jerseys to the United States of America, to be disposed of according to law,

8

including all right, title, and interests of Saleh Muqbel Saeed, Muneer Muqbel Saeed, Sami

9

Ali Muthana, and the Shoe Farm.

10

5. All parties shall bear their own costs and attorney’s fees.
