Plaintiff Arthur Torlucci, a state prisoner proceeding pro se and in forma pauperis, filed this
16
civil rights action pursuant to 42 U.S.C. § 1983 on March 22, 2013. On May 6, 2013, Plaintiff filed
17
a second amended complaint. However, this action was dismissed, with prejudice, for failure to state
18
a claim on April 30, 2013.

Accordingly, Plaintiff’s second amended complaint is HEREBY ORDERED STRICKEN
from the record.
