On June 17, 2014, Defendant Graham Packaging filed a motion to for reconsideration of

17 the Magistrate Judge’s order granting Plaintiff Sargis Sarkizi’s motion to amend. The motion for
18 reconsideration is set for hearing on July 28, 2014. On June 24, 2014, Plaintiff filed an
19 opposition. Defendant filed its reply on July 18, 2014. Having reviewed the pleadings of record
20 and all competent and admissible evidence submitted, the Court finds this matter suitable for
21 decision without oral argument. See Eastern District Local Rule 230(g). The hearing date of
22 July 28, 2014 is hereby VACATED and the parties shall not appear at that time. The Court will
23 take the matter under submission and thereafter issue its decision.
