Plaintiff is a state prisoner proceeding pro se and in forma pauperis in a civil rights

action brought pursuant to 42 U.S.C. § 1983. On October 11, 2016, the parties filed a
19
stipulation for voluntary dismissal of the action with prejudice, each party to bear its own
20
costs, fees, or expenses. (ECF No. 84)

Pursuant to Rule 41(a)(1)(A)(ii), the case has automatically terminated.

Accordingly, the Clerk is directed to CLOSE this case pursuant to the parties’
23
stipulation.
