(“MPN”), Cross-Defendant Western Surety 3 Company (“Western”), and Third-Party Defendant Apex Directional Drilling, LLC (“Apex”). 4 Pursuant to that Stipulation, 5 IT IS HEREBY ORDERED THAT: 6 1. MPN’s claims against Apex are hereby DISMISSED WITHOUT 7 PREJUDICE; 8 2. Apex’s claims against MPN and Western are hereby DISMISSED WITHOUT 9 PREJUDICE; 10 3.
