Accordingly, IT IS 21 HEREBY ORDERED: 22 1. The matter is DISMISSED WITHOUT PREJUDICE; and 23 2. The Clerk of Court is DIRECTED to close this action. 24 25 26 27 IT IS SO ORDERED.
