On September 19, 2017, the Ninth Circuit Court of Appeals reversed and remanded this

action to the Commissioner for further administrative proceedings. (Doc. 20). The judgment of the

Ninth Circuit Court of Appeals took effect on November 3, 2017. (Doc. 21).

Pursuant to the judgment of the Ninth Circuit Court of Appeals, this action is REMANDED

17

to the Commissioner for further proceedings consistent with the Ninth Circuit’s Order. The Clerk of

18

Court is DIRECTED to close this action.
