On March 3, 2015, the Court dismissed the action for failure to state a cognizable 17 claim. Plaintiff appealed. 18 On March 13, 2015, the United States Court of Appeals for the Ninth Circuit referred the 19 matter back to this Court for the limited purpose of determining whether in forma pauperis status 20 should continue for the appeal or whether the appeal is frivolous or taken in bad faith. 28 U.S.C. 21 § 1915(a)(3). 22 The Court finds that this appeal is not taken in bad faith and is not frivolous. 23 Accordingly, in forma pauperis status should not be revoked and should continue on appeal. 24 IT IS SO ORDERED. 25 Dated: 26 /s/ Barbara March 17, 2015 A.
