WAGNER, United States Attorney for the 19 Eastern District of California, including the Declaration of Revenue Officer Michael J. 20 Papasergia, it is hereby: 21 ORDERED that the Respondent, JOSE OCHOA, appear before Senior United States 22 District Judge Anthony W. Ishii, in that Judge’s courtroom in the United States Courthouse, 23 2500 Tulare Street, Fresno, California, 93721, on November 9, 2015 at 1:30 p.m., and that 24 Respondent show cause as follows: 25 1. Why Respondent, JOSE OCHOA, should not be held in civil contempt of this 26 Court for his failure to comply with the Order filed November 17, 2014, directing 27 Respondent to comply with the I.R.S. Summons issued on October 31, 2013. 28 /// 29 30 ORDER TO SHOW CAUSE RE: CIVIL CONTEMPT 1 2. 1 Why the Respondent should not be incarcerated and ordered to pay a daily fine 2 until he complies with the Order, and ordered to pay a compensatory fine to the United 3 States. 4 IT IS FURTHER ORDERED that within seven (7) calendar days after the filing of 5 this Order, the Respondent shall file and serve a written Response to the Order Adopting 6 Findings and Recommendations filed November 17, 2014. Only those issues brought into 7 controversy by the responsive papers and supported by declaration will be considered at the 8 hearing on this Order, and any uncontested allegation in the Petition will be considered 9 admitted. 10 Respondent is hereby notified that a failure to comply with the Order will subject 11 Respondent to possible further sanctions for contempt of Court. 12 13 14 IT IS SO ORDERED.
