Plaintiff has failed to file an amended complaint or otherwise respond to 22 the Court’s order. As a result, there is no pleading on file which sets forth any claims upon which 23 relief may be granted. 24 /// 25 /// 26 /// 27 /// 28 /// 1 Accordingly, pursuant to 28 U.S.C. § 1915A and 28 U.S.C. § 1915(e), IT IS HEREBY 1 2 RECOMMENDED that: 3 1. This action be DISMISSED, with prejudice, based on Plaintiff’s failure to state a claim 4 upon which relief may be granted under section 1983; and 5 2. 6 1915(g). Silva v. Di Vittorio, 658 F.3d 1090, 1098-99 (9th Cir. 2011). 7 These Findings and Recommendations will be submitted to the United States District Judge This dismissal be subject to the “three-strikes” provision set forth in 28 U.S.C.§ 8 assigned to the case, pursuant to the provisions of Title 28 U.S.C. § 636(b)(l). Within thirty (30) days 9 after being served with these Findings and Recommendations, Plaintiff may file written objections 10 with the Court. The document should be captioned “Objections to Magistrate Judge’s Findings and 11 Recommendations.” Plaintiff is advised that failure to file objections within the specified time may 12 result in the waiver of rights on appeal. Wilkerson v. Wheeler, 772 F.3d 834, 838-39 (9th Cir. 2014) 13 (citing Baxter v.
